What Can Happen When You Don’t Know All The Rules...
 
When Donna and Jim’s marriage started to crumble, all she wanted to do was move out and move on. She agreed to let Jim keep the house, and in exchange, she would get her portion of the equity and the car.
After working out all the details, she gladly signed the quit claim deed and settlement agreement so that the divorce could be finalized.
Three years go by, and Donna is past the pain of divorce and beginning to rebuild her life. She’s found the perfect home to start over in, and is going through the loan process to get approved for a mortgage.
When the lender pulls her credit report, she is shocked to see that the old mortgage is showing up. On top of that, she discovers that her ex is seriously behind on the house payments.
She explains to the loan officer that her husband was awarded the house in the divorce and is responsible for the mortgage. As he declines her loan, he gently explains that creditors aren’t bound by divorce agreements.
Until her ex-husband refinances the loan or sells the house, she is equally responsible for the mortgage. Now her credit is ruined, she can’t make her ex sell the house, and she probably doesn’t have any legal recourse. How could this happen? By signing the quit claim deed, Donna relinquished all her rights to the marital house and has no control over what happens to it now.
When drawing up the divorce agreement, she should have requested that it include specific language requiring the house to be refinanced. In addition to this, another clause should have been added stating that she would be held harmless if her ex-husband defaulted on the mortgage.
If he did default, she could then sue him for the amount due. Also, if the court ever orders the house to be sold to satisfy a judgment, she would be paid back any lost funds out of the net profit.......
